These Terms of Service constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”), and Native1API (“we”, “us”, or “our”), concerning your access to and use of the Native1API.com website, Native1API AI API services, developer dashboard, documentation, and related integrations.

2. Description of Services

Native1API provides OpenAI-compatible AI API access for developers, SaaS products, agents, and automation platforms. The service provides account access, developer API keys, usage controls, billing, and model access through Native1API endpoints.

3. API Access & Token Responsibility

Access to our edge gateway endpoints requires account registration managed via Google Firebase Authentication. You are solely responsible for:

Maintaining the confidentiality of your active session credentials and Firebase ID Tokens.
Protecting any API keys stored in secure Native1API key storage.
All queries, prompts, and traffic dispatched through your account identifiers.

4. Dynamic Billing, Pricing & Payments

Our gateway utilizes a dynamic, volume-leveraged competitor pricing engine:

Pricing is calculated in USD per million tokens (USD/1M tokens) consumed during inference.
Rates may be updated based on model availability, market pricing, account terms, and published Native1API pricing.
All payments are processed securely through Stripe. You agree to pay all charges incurred at the prices listed on your console at the time of usage.

5. Intellectual Property Rights

Unless otherwise indicated, the Site, edge routing configurations, source code, database structures, designs, brand marks, and software layouts are our proprietary property. You are granted a limited, non-exclusive license to query our endpoints in accordance with these Terms.

6. Acceptable Use and Restrictions

You may not use our services to:

Violate any applicable laws, regulations, or third-party content terms.
Attempt to scrape, reverse engineer, or disrupt our V8 edge isolate security structure.
Submit prompts that violate safety guardrails or generate malicious content.
Create automated accounts or attempt to brute-force authentication headers.

7. Disclaimers & Limitation of Liability

THE NATIVE1API SERVICES AND ENDPOINTS ARE PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. YOU AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, NATIVE1API DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, AND SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OUR EDGE GATEWAYS.

8. Governing Law

These terms shall be governed by and defined in accordance with the laws of the United States. Native1API and yourself irrevocably consent that the courts of the United States shall have exclusive jurisdiction to resolve any disputes.
